Terms & Conditions

These Terms & Conditions ("Terms") govern your use of thelocalgamesco.com.au (the "Site") and your purchase of products from The Local ("we", "us", "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

The Local is operated by Dan Tadmore, trading as The Local (ABN 47925409565), based in Victoria, Australia.

1. Eligibility — 18+ Only

The Local is an adults-only product. By purchasing from us or using the Site, you confirm that:

  • You are at least 18 years of age;
  • You are legally permitted to purchase and consume alcohol in your jurisdiction; and
  • You will not provide the product to anyone under 18.

We reserve the right to refuse or cancel any order where we reasonably believe these conditions are not met. It is an offence under Victorian law (and equivalent laws across Australia) to supply alcohol-related products to minors.

2. Orders & Acceptance

All orders placed through the Site are offers to purchase, which we may accept or decline at our discretion. A contract is formed only when we send you an order confirmation email.

We reserve the right to:

  • Limit order quantities;
  • Refuse or cancel any order (including for suspected fraud, pricing errors, or stock issues); and
  • Correct any errors in pricing, product descriptions, or availability, even after an order has been placed.

If we cancel an order you have already paid for, we will refund the full amount.

3. Pricing & Payment

All prices are listed in Australian Dollars (AUD) and include GST where applicable. Shipping is calculated at checkout and is additional to the product price.

Payment is processed securely through Shopify Payments and other approved providers. We do not store your full payment card details.

4. Shipping & Delivery

We ship Australia-wide via Australia Post (MyPost Business). Estimated delivery times are provided as a guide only and are not guaranteed.

  • Orders are typically dispatched within 1–3 business days of payment.
  • You will receive tracking details once your order is dispatched.
  • Risk of loss passes to you upon delivery to the address you provide.
  • We are not responsible for delays caused by Australia Post, incorrect addresses provided by you, or events outside our control.

If your order has not arrived within a reasonable time, please contact us at dan@thelocalgame.com and we will assist with tracing it.

5. Refunds & Returns

We want you to love The Local. If you're not happy with your purchase, we're here to make it right.

Australian Consumer Law

Nothing in these Terms excludes your rights under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

14-Day Return Window

You have 14 days from the date of delivery to request a return. To be eligible, items must be unused, in their original condition, and in their original packaging.

How to Request a Return

Email us at dan@thelocalgame.com with your order number and reason for return. We'll respond within 2 business days with return instructions.

Refunds

Once we receive and inspect your return, we'll notify you of approval. Approved refunds are processed to your original payment method within 5–7 business days.

Damaged or Faulty Items

If your order arrives damaged or faulty, contact us within 7 days of delivery with photos and we'll arrange a replacement or full refund at no cost to you.

Return Shipping

Return shipping costs are the responsibility of the customer unless the item is faulty or we made an error with your order.

Non-Returnable Items

We cannot accept returns on items that have been opened and used.

6. The Game — Responsible Play Disclaimer

The Local is a card game intended for adults in social settings. Drinking is at your own risk. By playing, you acknowledge and agree that:

  • The game is intended as light-hearted entertainment, not a directive to consume alcohol;
  • You will drink responsibly and within your personal limits;
  • You will never drink and drive, operate machinery, or engage in any activity where alcohol consumption would be unsafe or illegal;
  • You will respect any player who chooses not to drink — substituting non-alcoholic alternatives is always acceptable;
  • You will not play with anyone under 18, anyone who is pregnant, anyone with a medical condition affected by alcohol, or anyone who has not consented to participate; and
  • You assume all risk associated with consuming alcohol while playing.

The Local, its founders, and its affiliates accept no liability for any injury, illness, property damage, embarrassment, hangover, lost friendships, missed Monday meetings, or any other consequences arising from playing the game.

7. Intellectual Property

All content on the Site — including the name "The Local", logos, card designs, artwork, copy, photography, and game rules — is owned by us or used under licence. You may not reproduce, distribute, modify, or commercially exploit any of this content without our prior written consent.

The Local is not affiliated with, endorsed by, or sponsored by the Australian Football League (AFL), any AFL club, or any player. References to football culture are made in a general, non-commercial spirit.

8. Use of the Site

You agree not to:

  • Use the Site for any unlawful purpose;
  • Attempt to gain unauthorised access to any part of the Site or its underlying systems;
  • Interfere with the Site's operation or security; or
  • Use automated tools (bots, scrapers) to access the Site without our written permission.

We may suspend or terminate your access to the Site at any time without notice if we believe you have breached these Terms.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with these Terms, the Site, or our products is limited to the amount you paid for the relevant product.

We are not liable for any indirect, incidental, special, or consequential loss, including loss of profits, loss of data, or loss of opportunity.

Nothing in these Terms limits any rights you have under the ACL that cannot lawfully be excluded.

10. Privacy

We collect and handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy [link]. By using the Site, you consent to that handling.

11. Changes to These Terms

We may update these Terms from time to time. The current version will always be available on the Site, and the "Last updated" date at the top will reflect any changes. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
